  4. InfoRecall is copyrighted by Curtram Investments. You should
  5. carefully read all the terms and conditions of this agreement
  6. prior to using this software.If you do not agree to the terms
  7. of this agreement, do not open the disk package. Promptly
  8. return the unopened disk package and other items that are part
  9. of this product to the place you obtained them for a full refund.

  11. COPYRIGHT 
  12. You may not sub license, assign or transfer the license or the
  13. program except as expressly provided in this Agreement. Any
  14. attempt otherwise to sub license, assign or transfer any of
  15. the rights, duties or obligations here under is void.

  17. LICENSE
  18. You have the non-exclusive right to use this software. You may
  19. not distribute copies of the software or documentation to
  20. others. This software can only be used on a single computer.
  21. You may not modify or translate the software or user manual
  22. without the prior written consent of Curtram Investments Ltd.
  23. You may not use, copy, modify, or transfer the software or any
  24. copy, modification or merged portion in whole or in part, except
  25. as expressly provided for in this license.

  27. BACH-UP AND TRANSFER 
  28. You may make backup copies of InfoRecall but not of the 
  29. documentation. Each backup copy must include the copyright
  30. notices. Installation of InfoRecall on your hard drive is
  31. permitted subject to these conditions. You may not sell, loan or
  32. give away copies of InfoRecall.
  33.  
  34. TERM
  35. This license is effective until terminated. You may terminate it
  36. at any time by destroying the software together with all copies,
  37. modifications and merged portions in any form.  It will also
  38. terminate upon conditions set forth elsewhere in this Agreement
  39. or if you fail to comply with any term or condition of this
  40. agreement.  You agree upon such termination to destroy the
  41. software together with all copies, modifications and merged
  42. portions in any form.

  44. LIMITED WARRANTY
  45. This software is provided "as is" without warranty of any kind,
  46. either expressed or implied, including, but not limited to,
  47. the implied warranties or merchantability and fitness for a 
  48. particular purpose.  The entire risk as to the quality and
  49. performance of the software is with you. Should the software
  50. prove defective, you (and not Curtram Investments Ltd. or an
  51. authorized personal computer dealer) assume the entire cost of
  52. all necessary servicing, repair or correction. Some states do
  53. not allow the exclusion of implied warranties, so the above
  54. exclusion may not apply to you. This warranty gives you
  55. specific legal rights and you may also have other rights which
  56. vary from state to state.
  57.  
  58. Curtram Investments Ltd. does not warrant that the functions
  59. contained in the software will meet your requirements or that
  60. the operation of the software will be uninterrupted or error
  61. free.  However, Curtram investments Ltd. warrants the 
  62. supplied diskettes to be free from defects in materials and
  63. workmanship under normal use for a period of ninety(90)
  64. days from the date of delivery to you as evidenced by a copy
  65. of your receipt.

  67. LIMITATIONS OF REMEDIES:
  68. Curtram Investments Ltd. entire liability and your exclusive
  69. remedy shall be: A. the replacement of any diskettes not
  70. meeting Curtram Investments Ltd. "Limited Warranty" and which
  71. are returned to Curtram Investments Ltd. or an authorized
  72. Computer Dealer with a copy of your receipt, or, B. if Curtram
  73. Investments Ltd. or the dealer is unable to deliver a
  74. replacement diskette(s) which is free of defects in materials
  75. or workmanship, you may terminate this Agreement by returning
  76. the program.
  77.  
  78. IN NO EVENT WILL CURTRAM INVESTMENTS LTD. BE LIABLE TO YOU FOR
  79. ANY DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS OR OTHER
  80. INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR
  81. INABILITY TO USE SUCH SOFTWARE EVEN IF CURTRAM INVESTMENTS LTD.
  82. OR ANY AUTHORIZED DEALER HAS BEEN ADVISED OF THE POSSIBILITY OF
  83. SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.

  85. Some states do not allow the limitation or exclusion of liability
  86. for incidental or consequential damages so the above limitation
  87. or exclusion may not apply to you.

  89. This Agreement will be governed by the laws of the Province of
  90. Ontario.  Should you have any questions concerning the Agreement,

  94. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND
  95. IT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU
  96. FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENTS
  97. OF THE AGREEMENT BETWEEN US WHICH SUPERSEDES ANY PROPOSAL OR
  98. PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS
  99. BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
